Some Democrats are worried that they gave the Prersident too much power in their autumn resolution concerning war in Iraq. They have sued to enjoin the President from engaging the Armed Forces in hostilities with Iraq. See
the suit .
The case probably will be dismissed, though I regard the motion of the government to dismiss is based on a species loose constructionist interpretation of the Presidential War Powers. To that line of argument, here's an excerpt from Records of the Federal Convention.
If the suit is found to have merit, it might be tricky to decide, but it might be very tricky to enforce. Imagine being a U.S. Marshal and someone tells you that you need to arrest the President for contempt.
